This Terms of Service Agreement ("Agreement") is entered into by and between Brenna McNeil, hereinafter referred to as the "Photographer", and the individual or entity engaging the services of the Photographer, hereinafter referred to as the "Client".

1. Services Provided:

The Photographer agrees to provide portrait photography services as agreed upon by both parties. These services may include, but are not limited to, photography sessions, editing, and delivery of final images.

2. Booking and Payment:

a. A non-refundable deposit of $25 is required to secure the date and time of the photography session. This fee is deducted from the total session cost.

b. The remaining balance is due on the day of the photography session.

c. Payment can be made via cash, Venmo, or PayPal.

3. Rescheduling and Cancellation:

a. The Client may reschedule the photography session at least 3 days prior to the scheduled date without penalty.

b. In the event of a cancellation by the Client, the booking fee is forfeited.

c. In the event of a cancellation by the Photographer due to unforeseen circumstances, the session will be rescheduled at a mutually agreed-upon date and time.

4. Conduct and Cooperation:

a. The Client agrees to cooperate with the Photographer to achieve the best possible results, including following any instructions provided by the Photographer.

b. The Client understands that disruptive behavior during the photography session may result in the session being terminated and forfeiture of the booking fee.

5. Ownership and Usage Rights:

a. The Photographer retains all rights to the photographs, including but not limited to, the right to reproduce, edit, and display the images for promotional purposes.

b. The Client is granted personal usage rights to the photographs for non-commercial purposes only.

c. The Client may not sell or otherwise distribute the photographs without the Photographer's written consent.

6. Delivery of Final Images:

a. The Photographer will deliver the final edited images to the Client within 2 weeks of the photography session.

b. Images will be delivered digitally via email.

7. Satisfaction Guarantee:

a. The Photographer strives for client satisfaction. If the Client is not satisfied with the final images, they may contact the Photographer within 7 days of receiving the images to discuss potential solutions.

8. Liability:

a. The Photographer is not liable for any injuries or damages sustained during the photography session.

b. The Client agrees to indemnify and hold harmless the Photographer from any claims, damages, or liabilities arising from the use of the photographs.

9. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of Idaho.

By signing below, both parties acknowledge that they have read, understood, and agree to abide by the terms and conditions outlined in this Agreement.
